Global Discovery School Faces Pressure After Court Order. School Management’s Silence Worries Many Parents

Global Discovery School, located at Ampad near Sevasi in Vadodara taluka, has become embroiled in a dispute. Due to the breach of conditions of the lease agreement executed between the school trust and the landowners, the Arbitration Centre had, in October last year, ordered the trust to vacate the school premises by May 31, 2026, and hand over possession to the other party to the lease agreement. In addition, the Arbitration Court had directed the school trust to pay more than Rs. 3.68 crore in outstanding rent to the landowners along with 9% interest within two months. However, even after seven months and despite the expiry of the stipulated deadline, the school trust has not complied with the arbitration order.

Education experts say disputes involving schools often create fear among parents because students can get caught in legal and administrative delays. In many such cases across India, parents only come to know about problems when schools face notices, court action or admission issues. Education activists have repeatedly said that schools must keep parents informed about any major legal or financial matter that may affect students.

As per the lease agreement, the trust was required to pay the land rent to the land and building owners on the 7th of every month based on the agreed building rent calculated on a building area of 29,543 square feet. Even after the lease agreement was executed, the trust failed to make timely payments and did not conduct financial and other dealings appropriately. Consequently, in 2018, the landowners issued several legal notices to the trust. The trust did not respond to these notices either.

Legal experts state that lease disputes involving educational institutions often become complicated because schools continue functioning while cases move through legal channels for years. In many cases, courts and arbitration panels try to balance property rights with the interests of students and parents. Arbitration is generally used to settle such disputes faster than traditional court cases.

Ultimately, against these alleged irregularities of the trust, landowners Uttam Patel and Ramesh Patel filed an arbitration petition before the High Court. Following the hearing, the High Court, in September 2023, ordered arbitration proceedings and appointed an arbitrator.

Senior education consultants say that CBSE-affiliated schools are expected to maintain proper infrastructure, legal permissions and financial transparency. Parents usually choose CBSE schools because they believe the schools provide stability and long-term academic support. Any uncertainty regarding land ownership or school operations can create concern among families, especially during admission season.

The High Court Arbitration Centre initiated proceedings regarding the dispute. After hearing arguments from the lawyers representing the landowners and the school trust and examining the documents submitted by both parties, the arbitrator delivered a decision in favour of the landowners in October 2025. The arbitrator ruled that the trust must vacate the premises and hand over peaceful possession to the claimants. The trust was granted time until May 31, 2026, to vacate the premises. Further, as per the arbitration judgment, the trust is required to pay Rs. 3,68,61,234 as rent to the landowners along with annual interest at the rate of 9%. Accordingly, the trust was required to make payment of the entire amount with 9% interest within 60 days of the judgment.

Legal observers say arbitration awards are legally binding unless challenged before a competent court. Failure to comply with such orders may lead to further legal proceedings, including execution petitions and enforcement action. In several previous disputes involving institutions, delays in implementing orders have created confusion among students and staff members.

The significant point is that even though seven months have passed since the arbitrator’s decision, the school trust has neither vacated the premises nor made any payment of the outstanding amount to the landowners.

More than 200 students from pre-primary to Standard 10 are studying in this CBSE-affiliated school. The school principal and management have not informed the parents about the arbitration award. As parents remain unaware of the situation, and to ensure that the future of these students, as well as new admissions, is not adversely affected, landowners Uttam Patel and Ramesh Patel have submitted written representations to the Vadodara District Education Officer’s office, the District Collector and the Education Minister.

Parents in similar disputes across different states have often demanded transparency from school management. Education campaigners say parents should receive timely updates whenever schools face legal, financial or operational issues. They argue that students should not suffer due to conflicts between property owners and school trusts.

If the Education Department of the Government does not take appropriate action in this matter and does not initiate proceedings to cancel the school’s recognition, the future of more than 200 currently enrolled students, as well as prospective students, may be put at risk. Experts believe that education authorities may now closely monitor the situation to ensure that students’ studies, examinations and admissions are not disrupted.
